KETIV Privacy Policy 

This privacy policy has been compiled to better serve those who are concerned with how their ‘Personally Identifiable Information’ (PII) is being used online. PII, as used in US and European privacy law and information security, is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. With respect to personal data received or transferred pursuant to the Privacy Shield Framework, KETIV is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, KETIV may be required to disclose personal data in response to lawful requests by public authorities, including national security or law enforcement requirements.  

Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personally Identifiable Information in accordance with our website. 

What personal information do we collect from the people that visit our blog, website or app? 

When registering on our site, as appropriate, you may be asked to enter your name, email address, phone number, interests or other details to help you with your experience. We never request sensitive data such as: race or ethnic origin, political opinions, religious or philosophical beliefs, memberships, biometric data, health issues or sexual orientation. 

In using our products or services, anonymous network information may be transmitted back to us to determine how users are interacting with our products, assist us with improving our products, and provide alerts regarding available software updates/upgrades. In some instances, KETIV may collect non-personal (aggregate or demographic) data through cookies, web logs, and web beacons. That information is used to improve the usability, performance, and effectiveness of the website. Please read the “Cookies” section below for more information.  

When do we collect personal information? 

We collect information from you when you register on our site, subscribe to a newsletter, respond to a survey, fill out a form or otherwise enter information on our site and provide us with feedback on our products or services. We will always tell you before we collect any Personal Information and will only use your Personal Information in the way specified when it was collected. Subsequently, we will not change the way your Personal Information is used without your consent.  

How do we use your personal information? 

We may use the information we collect from you when you register, make a purchase, sign up for our newsletter, respond to a survey or marketing communication, surf the website, or use certain other site features in the following ways: 

  • To personalize the user’s experience and to allow us to deliver the type of content and product offerings in which you are most interested. 
  • To allow us to better service you in responding to your customer service requests. 
  • To administer a contest, promotion, survey or other site feature.

How do we protect visitor information? 

We only provide articles and information. We never ask for personal or private information such as credit card numbers. We use regular Malware Scanning. We do not have an SSL certificate and do not conduct monetary transactions through our website. For our users’ security, KETIV utilizes a combination of industry-standard security technologies, procedures, and organizational measures to help protect your Personal Information from unauthorized access, use or disclosure. The platform on which our website is built, has been rigorously tested and undergone white box and black box scans by leading application security testing firms.  

KETIV authorizes access to Personal Information only for those employees who require it to fulfill their job responsibilities. While we strive to protect your Personal Information and follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security. How long do we retain personal information? 

KETIV will retain your information for as long as your account is active or as needed to provide you services.  We will retain and use your information as necessary to provide you with our website-based services, including our Customer Portal, targeted advertising and website content, comply with our legal obligations, resolve disputes, and enforce our agreements.   

Do we use cookies? 

Yes. A cookie is a small data file that is written to your computer’s hard drive by your web browser. A cookie file can contain and/or automatically collect information, such as a user identification code or IP address that a website will use to track the pages and number of times you have visited. The data read from these cookies may be linked to personally identifying (PII) and non-personally identifying (non-PII) information. 

Why do we use cookies?

We and our partners use cookies and similar technologies on the Site to personalize and optimize your browsing experience and the Site by:  

  • Providing you tailored content and advertisements,  
  • Enabling social media features,  
  • Safeguarding against spam and malware, 
  • Analyzing traffic, and user behavior,

Opting out (Cookies). 

Users can set preferences for how Google advertises to you using the Google Ad Settings page. You may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails or you can contact us at (info@KETIV.com).  

Will use within the KETIV online community cause disclosures of personal information?  

If you participate or contribute to KETIV’s blog, forums, wikis, and other pages within the KETIV website (“Community”), your handle and comments are publicly visible. Also, please recognize that certain forums may have additional rules and conditions. Each participant’s opinion within a forum or chat room is his or her own and does not reflect the opinion of KETIV. To request removal of your Personal Information from our blog or community forum, contact us info@KETIV.com. We display testimonials, with advanced permission, of customers on our site in addition to other endorsements. Such testimonials may include personal quotes along with the person’s name. If you wish to update or delete a testimonial or your personal quote, you can contact us at info@KETIV.com 

You may be requested to voluntarily provide Personally Identifiable Information during your use of the Site. That information shared with KETIV will also be shared with business partners and vendors providing hosting and other services for KETIV.

We may use third parties to provide support to our business such as: credit card processing, e-mail service providers and hosting services on the Site. When you request certain services, we will share your user information only as necessary for the third party to provide that service who are prohibited from using your user information for any other purpose. We do not store or process any Personally Identifiable Information not related to a use consented to by the user.  

Does KETIV disclose personal information to third-parties for any reason? 

We do not sell, trade or rent to outside parties, user Personally Identifiable Information. We may otherwise disclose your Personal Information when: (1) we have your express consent to share the information; (2) as required by law: subpoenas, court orders or other similar legal process; or (3) the need to protect the safety of the users of our website or exercise or defend the legal rights of KETIV concerning illegal activities, suspected fraud, or violations of KETIV’s terms of use.  

We share your information with third parties who help deliver our products and services to you. Examples include hosting our web servers, analyzing data, providing marketing assistance, and providing customer service (Netsuite, Aminian, Hubspot & Replyify). These companies will have access to your personal information as necessary to perform their functions, but they may not use that data for any other purpose. 

We may also share your personal data: 

  • With companies in our group and/or our affiliates; or 
  • With resellers, distributors and/or channel partners; or 
  • With any third party you have asked us to share your personal data with – such as Facebook or any other social media site if you have asked us to connect with your account. 

You may have accessed our website through a hyperlink from the website of one of our trading partners. If so, you consent to your personal details and purchase information, including behavioral patterns, being shared with that trading partner in accordance with our contractual relationship with them. 

Please remember that when you share information publicly on the Site, for example a comment on a blog post, it may be indexable by search engines, including Google, which may mean that the information is made public. 

If KETIV is involved in a merger or acquisition you will be notified via email and/or a prominent notice on our website of any change in ownership or future proposed uses of your Personal Information, along with any choices you may exercise regarding your Personal Information.   

Are third-party links part of this agreement? 

Occasionally, at our discretion, we may include or offer third-party products or services on our website. These third-party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. When linked to a third-party website, a user should review the written policy of that site, before proceeding or entering any Personal Information. KETIV has no ability or obligation to ensure the safety of third party websites and user acknowledges that they proceed into third party websites linked by KETIV at their own risk. KETIV will not knowingly refer a user to a deficient site.  

What are the implications with Google Analytics? 

Google’s advertising requirements can be summed up by Google’s Advertising Principles. They are put in place to provide a positive experience for users. https://support.google.com/adwordspolicy/answer/1316548?hl=en 

We use Google Analytics on our website. Google, as a third-party vendor, uses cookies to serve ads on our site. Google’s use of the DART cookie enables it to serve ads to our users based on previous visits to our site and other sites on the Internet. Users may opt-out of the use of the DART cookie by visiting the Google Ad and Content Network privacy policy. We along with third-party vendors, such as Google use first-party cookies (such as the Google Analytics cookies) and third-party cookies (such as the DoubleClick cookie) or other third-party identifiers together to compile data regarding user interactions with ad impressions and other ad service functions as they relate to our website  

California Online Privacy Protection Act (CALOPPA). 

CALOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. According to CALOPPA we agree to the following. 

Users can visit our site anonymously. Certain features, programs, educational seminars are not available without registration. Once this privacy policy is created, we will add a link to it on our home page or as a minimum on the first significant page after entering our website. Our Privacy Policy link includes the word ‘Privacy’ and can be easily be found on the page specified above. Users will be notified of any privacy policy changes on our Privacy Policy Page. Users are able to change their personal information: 

  • By emailing us; 
  • By calling us; 
  • By logging in to their account; 
  • By chatting with us or sending us a ticket. 

 

Does our site allow third-party behavioral tracking? 

It’s also important to note that we allow third-party behavioral tracking. We partner with a third-party ad network to either display advertising on our website or to manage our advertising on other websites. Our ad network partner uses cookies and web beacons to collect non-personal information about your activities on this and other websites to provide you targeted advertising based upon your interests. If you wish to not have this information used for the purpose of serving you targeted ads, you may opt-out by clicking here (or if located in the European Union click here). Please note this does not opt you out of being served advertising in general. You may continue to receive generic ads.   

What about persons under 16 years of age? 

If you are less than 16 years old, please do not send any user information to us–including information such as your name, address, or e-mail address. We do not knowingly collect (nor do we wish to collect) any personally identifiable information or other user information from children under the age of 16. In the event that we learn we have collected any personal information from a child under the age of 16, we will delete that information from our database and terminate the corresponding account, if any. We encourage you to discuss the Site with your parent or guardian. When it comes to the collection of personal information from children under 13, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, the nation’s consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online. We do not specifically market to children under 18.  

Fair Information Practices. 

The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information. 

Should a data breach occur, how will KETIV respond? 

Within seventy-two (72) hours of becoming aware of a data breach, notify users via email. As soon as possible, the creation of web notice, web tools, links and proposed corrective actions, if available. Companies must report breaches to national Data Protection Authorities (DPA) within 72 hours of first having become aware of the breach where feasible. Companies must provide specific information, which can be provided in phases, if it is not possible to provide it all at once. Additionally, companies must document breaches, including the effects of the breaches and any remedial measures taken. Data processors (i.e., vendors of the companies that collect the data) will also be required to notify the relevant company “without undue delay” after first becoming aware of a data breach.   

CAN SPAM Act. 

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations. 

We collect your email address in order to: 

 

  • Send information, respond to inquiries, and/or other requests or questions. 
  • Process orders and to send information and updates pertaining to orders. 
  • We may also send you additional information related to your product and/or service. 
  • Market to our mailing list or continue to send emails to our clients after the original transaction has occurred. 

 

To be in accordance with CANSPAM we agree to the following: 

 

  • NOT use false or misleading subjects or email addresses. 
  • Identify the message as an advertisement in some reasonable way.\ 
  • Include the physical address of our business or site headquarters. 
  • Monitor third-party email marketing services for compliance, if one is used. 
  • Honor opt-out/unsubscribe requests quickly. 
  • Allow users to unsubscribe by using the link at the bottom of each email.

Contacting us/Subject Access Request (SAR)/Data controller. 

If there are any questions regarding this privacy policy you may contact us using the information below. By submitting a user access request or Subject Access Request (“SAR”), KETIV will provide the following information free of charge: any personal information about the user that is being processed along with the reason, the identities of any persons or entities who have access to the personal information about the user, how any personal information may be used in automated decisions (if any) and the processes involved. 

General Data Protection Regulations (“GDPR”) of the European Union. 

KETIV certifies that it is compliant with the GDPR. The GDPR requires that Personal Data must be: 

Processed lawfully, fairly and in a transparent manner; collected for specified and legitimate purpose and not processed in a way which is incompatible with that purpose; limited to what is necessary in relation to purposes for which it is processed; accurate and kept current; kept for no longer than is necessary for the purposes for which it is processed; maintained with appropriate security of data; and controlled by a company who can demonstrate compliance. 

The GDPR provides a set of rights to EU residents. Companies must provide each of the following to EU residents: 

Right to access a copy of their data and information about how their data is being processed; right to have inaccuracies rectified without undue delay; right to erasure of personal data; right to restrict data processing; right to data in a common format; right to object; and right to a security breach notification within 72 hours of discovery. 

Can this policy change from time to time? 

We reserve the right to update this Privacy Policy to reflect changes to our practices. In making material changes we will notify you by email and/or notice on our website, prior to the change becoming effective.
